Heroes "What Hero Are You?" Tee vs. Poptastic's "What's Your Super Power?" Tee

Last year my husband, a huge sci-fi and comic book fan (who's actually a comic book writer/artist himself) came up with the idea of a t-shirt with icons/symbols to represent common "super powers" exhibited by various heroes we've all seen in cartoons, comic books, movies, and tv shows.
So we launched our original "What's Your Super Power?" t-shirt in February 2007:

Earlier today, in anticipation of Heroes season 3, I was looking at official Heroes t-shirts and chanced upon this:
Now does that look almost exactly like our design or what? The symbols have been re-imagined but the illustration style and typeface that was used are very similar to ours. I found these shirts here, here, and here. UPDATE: Edited to erase links.
Oh well...*shrugs*
I'll just leave it up to you now, dear customer. If you want an official but commercial Heroes tee, then go ahead and click the links above*. If you want to support indie designers like ourselves, you may purchase the original but non-Heroes-centric "What's Your Super Power?" t-shirt from our shop ... and thus have our undying gratitude. :)
*But if you really must have an official Heroes tee, I'd rather you check out the following instead (these are pretty cool):

Doesn't it make your blood boil when you see something like that!
I know that as designers, we can often have similar ideas... but come on... that looks too close for comfort in my oppinion!
We had a Heroes inspired design (that was bought by the one and only Adrian Pasdar!!) and then we had to remove it after a complaint by the studio - it's been re-invented into a "OBAMA for PRESIDENT"... but isn't quite the same :( At least I got one before it had to be removed! To my point though... I think that someone who is doing 'official' designs for Heroes, was doing a search online and that's when they found it! (it didn't use the show title, logo, character images, and so on... but it used the name "Petrelli" which was apparently a breach in intellectual property!). So I'm guessing that your design may have been seen and 'copied'!!!
How funny... David (my partner in life/business) also started out as a comic book artist/writer! He did the original pen illustration for "Little Alex".
